Peruvian Superfoods online store (hereinafter: PS) offers customers the possibility of online shopping, i.e. easy and simple selection of products and creation of purchase orders, secure online payment with payment cards through the bank or by PayPal and delivery of ordered items to any reachable address in the world entered by the customer during purchase. PS is registered and operates within the framework of the applicable legal regulations in the Peru.

Product range
PS has registered nutritional supplements in its assortment. The range of products sold online is in compliance with the positive legal regulations of the Republic of Serbia. All products are original products of our brand that have a valid license for circulation in the Peru.
PS independently decides on the product range and can change it without prior notice and/or subsequent notification to customers. Customers are welcome with suggestions for expanding and improving the range.

The image of the product is placed for the purpose of illustration of the product. Product images are updated in line with changes to the packaging and design of the products themselves.

More detailed information about the product, content, composition, purpose and other information are provided in the text on the page of the product itself. All information about products, including product description, purpose, instructions for use, content, composition, effect and the like, are taken from the product packaging and declarations, from the instructions contained in the product packaging, as well as from other documents provided and/or published by the manufacturer. Although we aim to keep all information accurate, complete and up-to-date, textual errors may occur. PS does not assume any legal responsibility for any event that may occur as a result of any such information being incorrect. The customer is obliged to check all information on the product packaging itself and in the instructions contained in the product packaging, after receiving the product.
The price
The displayed price of each product is in dinars and includes VAT. In the case of a product price reduction, the previous price of the product is shown, which has been crossed out, as well as the new price that is valid.
The prices of all products are formed and changed in accordance with the business policy, without the obligation of prior notice.
If it is not specifically stated on the product page, the price reduction of the product is valid until the end of the current month or until the intended stock of the product is sold out.
Given that the moment of purchase confirmation can be several days after adding the product to the basket, the prices of all products that have been added to the basket are updated at the moment of purchase confirmation, so the final price that will be calculated must always be checked in the specification when confirming the purchase.
Availability and delivery time
The availability of the product for delivery is indicated on the product page, i.e. whether the product is available for delivery and in what timeframe the product can be delivered to customers. The availability of all products is constantly updated, but it may happen that some of the items are not available when preparing the order. The approximate delivery time represents the best estimate of the time in which the product can arrive at the customer's address, however, depending on several factors, the delivery time may deviate from the above in some situations. Customer ratings
On the product page, all visitors are allowed to enter their experience or opinion about the product. Ratings / comments can be entered as visitors, and these comments are always published only with personal data entered by the customer or visitor. If a comment has been entered by the visitor, it is not possible for the visitor to subsequently request correction, modification or deletion of the comment.
All comments go through a content check before publication and appear on the page itself after the check, and at the latest after 24 hours. The content check and selection is not done on the basis of the product rating alone, every reasoned rating, even an unsatisfactory one, will be published. PS reserves the right not to publish some of the comments or to publish them with minor corrections that do not change the essence of the comment itself in case they violate the purpose for which they are intended, and in particular: comments with offensive content; comments that directly promote products that are not in our offer; comments that give an extremely unargued bad rating and we do not have confirmation that the product has actually been used; questions, comments and other content that does not describe a rating and/or experience with a specific product.
Data entry for delivery
When confirming the purchase, customers must enter the correct data for the delivery of the shipment: name and surname, address, country, contact phone number where they can be reached and e-mail.
Purchase is possible without registration. When purchasing without registration, the customer enters only the necessary data so that the order can be delivered: first and last name, address, e-mail address, contact phone number. If this option is selected, the customer must enter the necessary data again during the next purchase.
Payment
Customers can pay in the following ways:
- payment by payment cards online;
- payment by PayPal
Payment with Dina, Maestro, Visa, MasterCard and American Express payment cards is realized in cooperation with WSPay and is done on a separate page by simply entering data from your payment card. After you enter your card details and confirm the payment, the bank authorizes the transaction and your order is approved and in the process of being prepared for delivery. The shipping cost is included in the total bill you pay and there is no additional payment when collecting the shipment.

Conversion Statement
All payments will be made in European currency - EUR. The amount for which your credit card account will be charged is obtained by converting the price in your local currency into Euros according to the current exchange rate of the National Bank of Peru. When charging your credit card, the same amount is converted to your local currency at the exchange rate of the credit card association. As a result of this conversion there is a possibility of a slight difference to the original price listed on our website.
All payments will be effected in Euros (EUR). The amount your credit card account will be charged for is obtained through the conversion of the price in your local currency into Euros according to the current exchange rate of the Peruvian National Bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated in our web site.
Delivery
We deliver parcels to all places reachable by our courier service of the National Post
The maximum delivery time in accordance with the legislation is 30 days, however for most products the usual delivery time is about 15 days from the confirmation of the order. The estimated delivery time is indicated for each product on the product page, and the estimated delivery time of the entire shipment is equal to the longest delivery time of the individual products in the shipment.

Deliveries are usually made between 8 a.m. and 5 p.m. in accordance with the schedule of the local Post courier service, so it is necessary to enter the address where it is possible to receive the shipment during that period, as well as the exact contact phone number where the person who will receive the shipment is available.
Notifying customers about non-delivery or partial delivery
In the case of the impossibility of delivering the complete order, when the total value of less than 30% of the total value of the order is missing for completion, the buyer is delivered a shipment with the available products, with a reduction of the total amount for the price of the products that were not delivered, and without mandatory prior notification of the buyer about the incompleteness purchase orders. Customers certainly have the right to cancel the purchase, which they can use if they do not want an incomplete order.
In case of impossibility of delivery of the complete order or part of the product with a value greater than 30% of the total value of the order, as well as in case of impossibility of delivery of the shipment within 30 days, the buyer is informed as soon as possible and at the latest within 7 working days, in order to do possible change of the order, agreed partial delivery or canceled the entire order. The customer will not be able to be notified if he entered the wrong e-mail address, the wrong contact phone number or a phone number that has been unavailable for a long time during registration or purchase.
The total amount to be paid is always the amount of the final bill. If this amount is less than the amount paid by the customer by card online, after issuing the invoice, only the reduced amount per invoice is charged, while the difference is automatically released.
Changing and canceling an order before shipping
Customers can modify or completely cancel an order at any time after order confirmation until the time of shipment without any additional costs. Depending on the shipment, the type of delivery and the time of day when the order is confirmed, the shipment can be shipped within 1h to 72h (in the case of weekends), so for any change or cancellation it is best to contact us as soon as possible at superfoodsperuvian@gmail.com
Cancellation of purchase after dispatch / receipt of shipment (Right to withdraw from the purchase contract)
Buyers have the right to cancel the purchase at any time after the dispatch of the shipment and up to 14 days from the moment of receipt of the shipment, without giving a reason, in which case the buyer shall bear the costs of delivery and return of the product, as well as the cost of reducing the value of the product in case the products were unpacked from of the original packaging, in the amount determined after the return of the product. In the event that the product is not unpacked from the original packaging, the customer receives a full refund of the price of the returned product.
In order to exercise the right to withdraw from the purchase, without giving reasons, the buyer must send an e-mail to superfoodsperuvian@gmail.com with a request, i.e. a completed form.
In case of cancellation of the purchase after shipment or failure to collect the shipment from the courier service, the buyer bears the costs of delivery and return of the shipment. Depending on the method of payment for the order, this amount is charged from the payment card, from the paid amount, or a payment invitation is sent to the customer. If the customer has outstanding obligations, it is not possible to deliver new orders.
Warranty / product compliance
In accordance with legal regulations, all products are subject to fitness for purpose within 1 year from the date of purchase. For products for which the warranty is valid for longer than 1 year, customers receive a separate warranty card, for all other products, the customer's rights due to non-conformity / product failure can be exercised with proof of purchase (receipt).

Complaints about the lack of delivery of the order within the agreed time period should be submitted by the customer immediately after the deadline specified for the delivery of the ordered product has expired.
Complaints about the quantity received, deviations in the type of product from the ordered, possible damage or product quality, customers should send as soon as possible after receiving the shipment, i.e. no later than within 3 days of receiving the package.
The complaint must contain: customer identification data (name and surname, e-mail address registered during the order), order identification number (order / invoice number), as well as a detailed description of the complaint.
PS approaches the resolution of each complaint immediately upon receipt, but depending on the content of the complaint and the need to investigate several factors, the deadline for responding to the complaint is 7 days from the date of receipt of the last information for the complaint.
The basic principle by which PS is guided in resolving complaints is the principle of a good trader who cares about the satisfaction of his customers.
In accordance with the Law on Consumer Protection, if the buyer believes that his complaint was unjustifiably rejected, he can initiate a procedure for out-of-court settlement of the dispute with a dispute resolution body (mediator/intermediary) in which the participation of the seller is mandatory. The buyer can initiate the procedure through the appropriate service of the Ministry of Trade, Tourism and Telecommunications. Out-of-court settlement of disputes in accordance with the Law can last no longer than 90 days from the date of submission of the proposal.
REFUND

When you provide the necessary data, documentation will be created that will be forwarded to you with the refund procedure to the email address you left when creating the order.
Refunds are made exclusively in the above-mentioned manner, by payment to a EUR current account, and it is not possible to send money by courier in cash.
In the case of returning goods and refunding funds to a customer who previously paid with one of the payment cards, partially or in full, and regardless of the reason for the return, PS is obliged to make the refund exclusively via VISA, EC/MC and Maestro payment methods, which means that the bank will refund the funds to the card user's account at the seller's request.

On behalf of PS, we undertake to protect the privacy of all our customers. We collect only necessary, basic data about customers/users and data necessary for business operations and informing users in accordance with good business practices and with the aim of providing quality service. We give customers choices including the ability to decide whether or not they want to be removed from mailing lists used for marketing campaigns. All user/customer data is strictly stored and is available only to employees who need this data to perform their work. All employees of PS (and business partners) are responsible for respecting the principles of privacy protection.
In order to successfully process your order, we need your first and last name, address, e-mail and telephone number. With the help of this data, we will be able to deliver the desired goods to you, as well as inform you about the current status of the order. PS will use your personal data for the purpose of executing the sales contract for the products you have purchased, solving your requests, providing information about the products from our range as well as advertising them through newsletters and improving our services. PS will not sell the data it possesses to third parties, nor on the market. The employees of the company PS are obliged to respect the confidentiality of your data.

You can pay for your order using a Visa, Visa Electron, MasterCard, Amex or Maestro payment card. The card must be approved by the issuing bank for online (Internet) payment.

When entering payment card data, confidential information is transmitted via a public network in a protected (encrypted) form using the SSL protocol, which is currently the most modern cryptographic technology.
Data security during purchases is guaranteed by the payment card processor, Monri WSPay - Web Secure Payment Gateway, so the entire payment process is performed in a secure environment.
Payment card information is not available to our system at any moment.

Payment is not possible in foreign currency, but exclusively in EUR. Payment is possible with payment cards of domestic and foreign banks.
A customer who uses the online card payment service through the e-shop must meet the following conditions:
• Delivery of goods is possible on the reachable territory by our Post Service, at the address specified in the order.
• Only the owner of the payment card can make the payment.
